II. About Natalia Shop

Natalia Shop is an e-commerce service that offers its users the opportunity to take possession of the displayed products. Products are purchased based on orders received through the website or, exceptionally, by email, phone or text messaging applications.

III. Intellectual Property

The content and design of Natalia Shop, as well as any other related material sent by you by email or provided by you in any other way (example: articles, design, product description and any other materials), belong to the Company and/or its collaborators - where this is expressly specified - (copyright) and are protected by intellectual property legislation. You may not use, reproduce or permit anyone to use or reproduce the Natalia Shop Materials without the Company's prior written permission.

You may not use frames (frames in the sense of the HTML language) or framing techniques (framing techniques in the sense of the HTML language) for brands, logos, or other information protected by copyright law (including images, texts, interfaces, forms) of Natalia Shop without having prior written permission from the Company.

The Natalia Shop website can be accessed for free, and simply browsing its pages is not conditional on registering as a user (creating a user account on the Website). However, in order to benefit from certain services offered by the Site, such as purchasing the products offered by it, receiving the Natalia Shop newsletter or checking the status of your own orders, you will need to register as a user (create a user account on the Site). Registering as a user implies your prior acceptance of Natalia Shop's Terms and Conditions of Use and its Privacy Policy. These regulations constitute the contractual basis of the relations between users and the Company.

Natalia Shop may sell products to children under 14 (fourteen) years of age, but sells to adults, who are authorized to make online payments by card or any other payment method accepted by Natalia Shop. If you are under 14 (fourteen) years old, you can purchase Natalia Shop products only with the help of a parent or guardian.

Natalia Shop reserves the right to close user accounts, modify or remove texts, images, hyperlinks, or refuse the sale of products, at its own discretion.

By registering as a user of Natalia Shop, we will ask you for a series of personal data, such as your name and surname, email address, date of birth and other personal information, which will allow you to be identified as a user of the Natalia Shop service. Also, in order to subscribe to the Natalia Shop newsletter or alerts, you will need to provide us with a valid e-mail address as well as other data related to you. Please access the page where the Privacy Policy is presented to you to inform yourself about the information collected by Natalia Shop, how it is used, as well as your rights regarding the protection of your privacy.

VI. Purchase procedure

To buy and take possession of the products offered for sale on Natalia Shop, it is necessary to go through the following steps:

• product identification and selection
• your registration as a Natalia Shop user
• making the payment for the products. Payment is made online or cash on delivery
• the delivery of the products ordered and paid for will be accompanied, if applicable, by the warranty certificate, the certificate regarding the after-sales service provided by the manufacturer/importer/distributor and/or other certificates, if applicable.

By placing an electronic or telephone order on Natalia Shop, you agree to the form of communication (telephone or e-mail) through which the Site conducts its operations.

VII. How do I buy?

VII.1. The prices

Unless otherwise stated, product prices displayed on Natalia Shop represent final purchase prices and include all applicable taxes.

The final purchase prices can be suggested prices by manufacturers or suppliers, or can be estimated according to the standard prices applicable in the industry of the traded product. Final purchase prices may not represent the most competitive prices in a particular product segment or for a particular period.

In certain time intervals Natalia Shop may offer customers free shipping above a certain value of the total shopping cart related to an individual order. Its value, as well as the validity period of the offer, are strictly at the discretion of Natalia Shop and do not engage Natalia Shop in any financial and/or contractual obligation.

Also, for the products that are not in stock at the time of the order, Natalia Shop does not undertake and does not undertake to deliver them later and does not ensure the maintenance of the price and commercial conditions existing at the time of the order.

VII.2. Payment methods

To pay for the ordered products, you can choose from the following payment methods: bank transfer/payment order or cash/cash on delivery. If you have chosen bank transfer/money order as your payment method, the next screen thanks you for placing your order and provides you with the relevant order and payment information. You will also receive this information by e-mail, in the form of an invoice (details in chapter VII.2.1). If you have chosen to pay cash/cash on delivery, after placing the order you will receive by e-mail the relevant information for your order, in the form of an invoice, and you will make the payment of the product to the person making the delivery.

Delivery is made by fast courier and the cost is displayed at the end of the order, on the dedicated page.

Also, each product has a delivery estimate, which we ask you to take into account, and we also inform you that during busy periods there may be delays in the manufacturing and delivery process.

Orders over 500 lei receive free delivery.

Edible products have the expiration date written on the packaging. Non-edible products benefit from the usual guarantee (2 years for individuals, 1 year for companies/legal entities).

IX. Product description and returns

Natalia Shop makes every effort to be as accurate as possible. However, Natalia Shop does not warrant that product descriptions or other related materials are accurate, complete, current or error-free. If a product offered by Natalia Shop is different from the corresponding description on the Site, you can return it in compliance with the provisions of the Site's Product Return Policy and in accordance with Romanian legislation in force.

Please refer to the pages dedicated to the return procedure (and related exceptions) and also, very importantly, to refer to the page dedicated to the procedure of purchasing and delivering products, to get a clear idea of ​​the whole process itself and to order in an informed manner.

We mention, as a very important aspect, the fact that all our products have a delivery estimate, depending on the type and category they belong to. This estimate can be found in the area next to the product price and the "add to cart" or "buy" buttons on each product's page. Therefore, you must access the dedicated page of each individual product to be able to consult the delivery estimate of your product. You will also have a warning message about this when you try to place the order, right on the checkout page. Please take note of all these messages and warnings because the products, once ordered, go into production or international transfer between warehouses (depending on the categories and types of products ordered) and it is difficult to impossible to change your mind.

However, if you change your mind or a problem occurs that prevents you from using the products, please let us know as soon as possible at contact@naticake.com and we will find the most optimal solution for you - store credit for a value as close as possible (or the whole) of the value of the order placed by you.

IX.I Products with missing stock / out of stock / other situations

Some products on our store arrive to us from an external warehouse or from the suppliers' external stock. In some situations it may happen that a product appears as being in stock, the customer places the order but, unfortunately, there is a logistics problem or a stock outage from the manufacturer / supplier that affects the entire product delivery process and, in this case, in order not to cause any harm to the Customer, the Store can decide to cancel the order and return the money within a maximum of 14 working days, in an IBAN account made available by Client.

IX.II Products brought on the basis of firm order and payment in advance

Certain products displayed on the website are not kept in our current stock and are brought exclusively on the basis of a firm order and payment in advance, at the express request of the customer.

These products are clearly marked on the product page with a mention of extended delivery and individual import status.

According to GEO no. 34/2014, art. 16 lit. c, the consumer does not benefit from the legal right of withdrawal in the case of these products, as they are considered products "supplied based on the specifications presented by the consumer or clearly personalized".

By placing an order for these products, the customer explicitly accepts the stated conditions and understands that, once the order is confirmed, it cannot be canceled for normal commercial reasons.

In exceptional circumstances, we may offer, upon request, an alternative solution such as store credit or a replacement product.

X. Reviews, Comments, Communications and Other Content

Users may post reviews, comments or other content; send suggestions, ideas, ask questions, propose articles or other types of materials, as long as their content is not illegal, obscene, threatening, defamatory, does not violate the right to privacy or the law regarding the protection of intellectual property; it does not contain computer viruses, commercial, political communications, which incite hatred or intolerance on ethnic, religious, racial, sexual orientation grounds, collective messages or other forms of spam. In order to post reviews, comments, communications and other types of content, you may not use false email addresses or identities. Natalia Shop reserves the right, but has no obligation, to remove or edit all types of content posted by users and has no obligation to periodically review this content. With the posting of reviews, comments, communications and other types of content on Natalia Shop, you transfer, except in cases where the Company indicates otherwise, the intellectual property rights, non-exclusively, perpetually, irrevocably, to the posted materials. Natalia Shop is not responsible and assumes no responsibility for any of the materials posted by other third parties on the Site. Natalia Shop has the right not to publish all comments and articles proposed by users.

XI. Force Majeure

Natalia Shop, its affiliates and/or generally suppliers of products or services to Natalia Shop cannot be held responsible for any delay or error resulting directly or indirectly from causes beyond Natalia Shop's control. This exemption includes, but is not limited to: errors in the operation of Natalia Shop's technical equipment, non-functioning internet connection, non-functioning telephone connections, computer viruses, unauthorized access to Natalia Shop systems, operating errors, as well as cases of force majeure stipulated by Romanian legislation in force.

XII. Advertising

Natalia Shop can display, on its pages, advertisements for the products in its offer as well as for products or services belonging to third parties. By using Natalia Shop and by accepting its Terms and Conditions of Use and Privacy Policy, you directly express your consent to be the recipient of these commercial communications.

XIII. Claims of Violation of Intellectual Property Law

Natalia Shop respects the intellectual property rights of third parties.
